CSM Mentoring challenge: Official rules

Competition Overview: CSM is creating a mentoring program for women passionate about building a career in the sports industry, providing them with senior executive perspective and a network of like-minded women. Our goal is to create opportunities for women looking to progress in the sports business industry.

  1. Sponsor: CSM Sport and Entertainment, Inc., 80 8th Avenue, 5th Floor, New York, NY 10011 (“Sponsor”).

  2. Eligibility: The “CSM Mentoring Challenge” ("Competition") is open only women who are to legal residents of the 50 United States and the District of Columbia, at least 21 years of age (or the age of majority in the jurisdiction of their residence, whichever is older) at time of entry and who have a valid e-mail account and Internet access as of the beginning of the Competition. Potential winners will be required to provide proof of eligibility upon request prior to prize award. Void where prohibited by law.

  3. Competition Entry: The Competition begins on or about 12:00 pm Eastern Time (ET) on 7/24/23 and ends 11:59 pm ET on 9/8/23 (“Promotion Period”). Sponsor’s computer is the official clock for this Competition.

    Step 1 – Navigate to Website

    Navigate the internet to www.CSMMentoringChallenge.com (“Website”).

    Step 2 – Personal Information

    Complete the entry form (that is, the mentee application) with your first and last name, mailing address, e-mail address, phone number, date of birth, years involved in the sports industry, organization (company) and title.

    Step 3 –Answers to Questions

    In 250 words or less you must respond with original answers to a series of questions/prompts such as the following: “Describe a facet of your identity, background or story that is essential to who you are”, “Tell us about a moment you are most proud of (personal or business related” and “What unique impact do you believe you will have on the future of the sports business/industry and how will this opportunity help you to get there?”. The content of your answers must comply with the content restrictions set forth below.

    Step 4 – References

    You must submit two (2) professional references. Each reference must include the full name, position, email address and phone number of the person.

    Step 5 – Resume 

    You must upload the most recent version of your resume. The resume must be in either Word or PDF.

    The completed personal information, answers to questions, name and contact information of supervisor and references as well as resume constitute your entry. All elements of entry must be submitted during the same on-line session; partial/piecemeal entries will NOT be accepted. Once submitted, the entry cannot be modified, altered or amended by you unless expressly requested by Sponsor.

    BY SUBMITTING AN ENTRY, YOU REPRESENT AND WARRANT THAT ALL INFORMATION PROVIDED AS PART OF THE ENTRY (INCLUDING BUT NOT LIMITED TO THE STATEMENTS ON THE RESUME) ARE TRUTHFUL AND COMPLETE, WITH THE UNDERSTANDING THAT SPONSOR IS DIRECTLY RELYING ON THE TRUTHFULNESS AND COMPLETENESS OF THE INFORMATION CONTAINED IN YOUR ENTRY. YOU FURTHER CONSENT (AND AGREE TO PROVIDE ANY ADDITIONAL CONSENTS AS NECESSARY UPON SPONSOR’S REQUEST AND WITHOUT COMPENSATION) TO SPONSOR CONTACTING YOUR SUPERVISOR AND REFERENCES, AS WELL AS VERIFYING ANY OTHER INFORMATION INCLUDED IN YOUR ENTRY WITHOUT FURTHER NOTICE TO OR APPROVAL BY YOU.

    IF YOU DO NOT CHECK THE BOX INDICATING YOUR AGREEMENT TO THE OFFICIAL RULES, YOU WILL NOT BE ELIGIBLE TO ENTER THE COMPETITION OR WIN A PRIZE.

    Limit one (1) entry per person during the Promotion Period. Multiple entries in excess of the stated limitation or mass entry attempts by any method may result in disqualification of all entries by such person Joint/group entries are not allowed. Entries must be manually key-stroked by the entrant; use of automated entry devices or programs, or entries by third parties by any method of entry, is prohibited. Entries must be in English. Entries must be received and recorded by the Sponsor’s computer by the end of the Promotion Period, 11:59 pm ET on 9/8/23, to be eligible to win. Entries that do not conform to these Official Rules or are submitted in any manner other than stated in these Official Rules will be disqualified.

    CONTENT RESTRICTIONS: The content of answers must comply with the following requirements (as determined by Sponsor in its sole discretion) –

    • CANNOT violate or infringe upon the rights of any party (including copyright, trademark, right of privacy, right of publicity);

    • CANNOT be inappropriate, obscene, hateful, or otherwise unfit for publication;

    • CANNOT advocate the use of alcohol or drugs, acts of violence or illegal behavior of any kind;

    • CANNOT disparage or damage the goodwill and/or business reputation of Sponsor, including any publication of American City Business Journals;

    • MUST BE relevant to the applicable question;

    • MUST BE truthful.  

  4. Judging/Winner Notification: At the conclusion of the Promotion Period, all eligible Entries received and recorded during the Promotion Period will be judged by an official judging panel, consisting of representatives of Sponsor. The judging panel will select winning entries from among all eligible entries received based on the following criteria: creativity/originality (50%); ambition and potential (30%); and strength of resume (20%). (But, Sponsor reserves the right in their sole discretion and without liability of any kind to select fewer than fifteen (15) winning entries due to lack of quality entries received or for any other reason.) In the event of a tie, the Entry from among all such tied entries with the higher/highest score in the “Creativity/Originality” criterion will be considered the winner. Decisions of the judges are final and binding in all respects.

    Potential winners will be notified by e-mail and/or phone on or about 10/10/23. Failure to respond to the initial verification e-mail within three (3) business days of notification or return of e-mail notification as undeliverable after two (2) attempts will result in disqualification. Each potential winner may be required to sign and return within three (3) business days of notification an Affidavit of Eligibility, Release and Indemnification, and a Publicity Release where allowed by law. If the Affidavit of Eligibility, Release and Indemnification and Publicity Release is not returned to Sponsor within specified time period, potential winner may be disqualified. If winner is disqualified for any reason, prize, as discussed below, will be forfeited without compensation of any kind and an alternate winner may be selected from all remaining eligible entries received during the Promotion Period as per the judging procedure set forth above, time permitting.

  5. Prizes, Approximate Retail Values ("ARV"):

    GRAND PRIZE: Each Grand Prize winner will receive the following: one (1) invitation to SportsBusiness Journal’s 2023 Game Changers Conference 2023 to be held on October 24 2023, and a one-on-one mentorship from a woman with senior executive experience in the sports industry (mentor to be selected by Sponsor in its sole discretion).

    ARV of Grand Prize: $299.00.

    Total ARV of all prizes: $4,485.00.

    WINNERS ARE SOLELY RESPONSIBLE FOR ALL COSTS AND INCIDENTALS NOT SPECIFIED HEREIN.

    WINNER MUST BE ABLE TO ATTEND SPORTSBUSINESS JOURNAL’S 2023 GAME CHANGERS CONFERENCE ON OCTOBER 26, 2023 IN PERSON OR VIRTUALLY; IF WINNER IS NOT AVAILABLE ON SUCH DATE FOR ANY REASON, PRIZE WILL BE FORFEITED AND AN ALTERNATE WINNER MAY BE SELECTED (TIME PERMITTING).

    Winner conduct her/himself at all times in a socially responsible, appropriate and well-behaved manner; failure to do so will result in immediate ejection of winner from Conference, Speaker Series and/or mentorship opportunity. In such case, Sponsor shall have no further liability or obligation to winner and Sponsor expressly reserves the right to pursue all available legal remedies against such winner.

    Mentorship opportunity will consist of private meeting(s) with assigned mentor. Such meetings will be private and be held online on a virtual platform of mentor’s choosing. Sponsor expressly disclaims any and all liability in conjunction with advice and guidance provided by assigned mentor, Winner understands and agrees that mentor is acting completely an independent capacity in providing mentorship services and is not an employee or agent of the Sponsor.

    Prize must be accepted as is. Prize elements may be subject to availability and other restrictions. No substitution, cash redemption or transfer of prize. Sponsor in its sole discretion may award a substitute prize/prize component of equal or greater value if advertised prize/prize component is unavailable at time of awarding for any reason to the extent applicable. All taxes are the sole responsibility of the Grand Prize Winners.

  6. Release of Liability: Sponsor’s failure to enforce any provision of these Official Rules shall not constitute the waiver of such provision. Released Parties (as defined below) are not responsible for lost, late, incomplete, stolen, misdirected, illegible entries, submissions, responses, email; or for any computer, telephone, wireless, satellite, cable, network, electronic, Internet or phone hardware or software malfunctions, failures, connections, or availability, or garbled, corrupt or jumbled transmissions, service provider/Internet/website/use net/accessibility, availability, or traffic congestion, Internet contact, or any technical error, or program errors or malfunctions or unauthorized human intervention, or the incorrect or inaccurate capture of entries, submissions, responses, email, or other information, or the failure to capture, or loss of, any such information. If for any reason the Competition is not capable of running as planned (in whole or in part), as solely determined by Sponsor, including but not limited to by infection by computer virus, bugs, tampering, unauthorized intervention, fraud or technical failures that can corrupt or affect the administration, security, fairness, integrity or proper conduct of the Competition, Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Competition. In such event, Sponsor shall conduct the Competition and award the Competition prizes in a manner which is fair, appropriate and consistent with the spirit of these Official Rules, as determined by Sponsor in its sole discretion from among non-suspect eligible entries received as of the termination date. Notice of cancellation/termination/modification/suspension of Competition will be posted on the Website. The right is reserved by Sponsor to disqualify any entrant who is found, at Sponsor’s sole discretion, to be tampering with the entry process or the operation of the Competition or Website, to be acting in violation of the Official Rules; or to be acting in a non-sportsmanlike or disruptive manner, with intent to annoy, abuse, threaten or harass any other person, or who has sought to misrepresent information or otherwise deceive/defraud Sponsor in submitting an entry. No responsibility is assumed for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure (whether wireless or Internet), theft or destruction or unauthorized access to (or any problems or technical malfunctions of) any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or electronic entry (or the incorrect or inaccurate capture of entry, submission, response, email, or other information, or the failure to capture, or loss of, any such information) on account of technical problems or traffic congestion on the Internet or at the Website, or any combination thereof. Released Parties are not responsible for any injury or damage to entrant's or any other person's computer related to or resulting from participation in or downloading any materials from this Competition. Further, Released Parties are not responsible for any incorrect or inaccurate information, whether caused by Web site users, tampering, hacking, or by any of the equipment or programming associated with or utilized in the Promotion.

    Entrants further agree not to damage or cause interruption of the Competition and/or prevent others from participating in the Competition. CAUTION: ANY ATTEMPT TO DAMAGE ANY ONLINE SERVICE OR WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE COMPETITION VIOLATES CRIMINAL OR CIVIL LAWS. IF SUCH AN ATTEMPT IS MADE OR AN INDIVIDUAL OTHERWISE ATTEMPTS TO DEFRAUD SPONSOR, SPONSOR MAY DISQUALIFY ANY ENTRANT MAKING SUCH ATTEMPT AND SEEK DAMAGES TO THE FULLEST EXTENT OF THE LAW.

  7. Conditions and Limitations of Liability: By participating, entrants agree to be bound by and abide by these Official Rules and the decisions of Sponsor (including the judging panel) regarding the Competition (including the judging of Entries), which shall be final and binding in all respects. By participating in this Competition, entrants agree to release and hold harmless Sponsor, its respective parent, subsidiary, affiliated and successor companies, advertising and promotion agencies and prize suppliers, and each of their respective officers, directors, agents, representatives and employees, as well as each of their respective successors and assigns, as well as Facebook, Inc., Twitter, Inc., LinkedIn, Instagram, LLC, and Google Inc., (collectively and individually, the "Released Parties") from any and all actions, claims, injury, loss or damage (whether due to negligence or otherwise) to person(s), including death, or property, or infringement upon any third party’s rights, (including but not limited to, copyright, patent or trademarks/tradenames/logos, or rights of privacy or publicity, or inclusion of material that is or may be considered defamatory, slanderous or libelous, or portray or depict any person, product or entity in a false light) arising in any manner, directly or indirectly, in whole or in part from participation in this Competition, or any Competition related activity, and/or acceptance, possession, misuse or use of any prize. By accepting prize, prize winners authorize the Sponsor, and those acting pursuant to the Sponsor’s authority to use their names, voices, likeness, photographs, prize information, biographical data and city and state of residence in any media know known or hereafter discovered, world wide, including on the World Wide Web and Internet, in perpetuity, at any time or times, in advertising, trade and/or promotional material or on a winners' list (if applicable) without additional compensation (unless prohibited by law) or notice, review or approval. Sponsor is not obligated to use any of the above mentioned information or materials, but may do so and may edit such information or materials, at Sponsor’s sole discretion, without obligation or compensation.

    IN NO EVENT WILL RELEASED PARTIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF WEBSITE OR THE DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM SAID SITE. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THIS SITE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.

  8. Disputes: Arbitration/Choice Of Law: Except where prohibited, entrants agree that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Competition, or the award of prizes/determination of prize winners, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration pursuant to the Rules of the American Arbitration Association, then effective; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Competition but in no event attorneys’ fees; and (c) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and/or Released Parties in connection with the Competition, shall be governed by, and construed in accordance with, the laws of the State of New York, without regard for conflicts of law doctrine of the State of New York or any other jurisdiction, and all proceedings shall take place in the City of New York, County of New York.
